Trafficking Cannabis


I represent clients charge with all Federal Drug Charges, including:

Sentencing on a federal drug charge is done pursuant to the Federal Sentencing Guidelines and the Mandatory Minimums set by statute and based on the type and amount of cannabis or the number of plants found, an individual could face a mandatory minimum sentence of 5 years up to mandatory life in prison and/or up to a fine not to exceed $50 million dollars.

Under 50 kilograms of cannabis, 10 kilograms of hashish, 1 kilogram of hashish oil, or 1 to 49 plants: Up to 5 years imprisonment and a fine not to exceed $250,000.00 for an individual or a fine not to exceed $1 million if defendant is other than an individual.

50 to 99 kilograms of cannabis or 50 to 99 plants: A minimum of 5 years up to 40 years imprisonment and a fine not to exceed $5 million for an individual or a fine not to exceed $25 million if defendant is other than an individual.

100 to 999 kilograms of cannabis or 100 to 999 plants: A minimum of 5 years up to 40 years imprisonment and a fine not to exceed $5 million for an individual or a fine not to exceed $25 million if defendant is other than an individual.

1000 kilograms or more of cannabis or 1000 or more plants: A minimum of 10 years up to life imprisonment and a fine not to exceed $10 million for an individual or a fine not to exceed $50 million if defendant is other than an individual.

21 U.S.C. 841(a) Unlawful acts. Except as authorized by this subchapter, it shall be unlawful for any person knowingly or intentionally: (1) to manufacture, distribute, or dispense, or possess with intent to manufacture, distribute, or dispense, a controlled substance; or (2) to create, distribute, or dispense, or possess with intent to distribute or dispense, a counterfeit substance.
